Tesco drops Irish beef baron's firm over horsemeat row

LONDON/DUBLIN (Reuters) - Tesco fired a supplier controlled by Ireland's most powerful beef baron on Wednesday for selling it burgers containing horsemeat and promised to use DNA testing equipment to check the content of products on its shelves.

The world's No. 3 retailer, Tesco is reeling from a wave of bad publicity after the Irish food safety authority discovered that 29 percent of a frozen beef burger was horsemeat.

The move, which comes days after a similar move by Burger King, is a blow to Ireland's 2 billion euro ($2.6 billion) beef industry, which had hoped that the discovery the horsemeat came from Poland might limit the fallout.

"We took that decision with regret but the breach of trust is simply too great," said Tesco technical director Tim Smith said in a statement announcing the termination of its contract with Silvercrest, a subsidiary of Larry Goodman's ABP Foods.

ABP, Europe's largest beef exporter, tried to deflect blame for the scandal this week after the Irish government announced it had traced the source of the meat to a Polish supplier.

ABP said it had "never knowingly purchased or traded in equine product" but Tesco said it had failed to use meat from a list of approved suppliers and to honour an instruction to source ingredients exclusively in the UK and Ireland.

The damage to Ireland's reputation as a supplier could be hard to shake, analysts said.

"It's a spectacular own-goal for Ireland because it reflects on the beef industry as a whole," said Patrick Wall, lecturer in public health at University College Dublin. "A team is only as strong as its weakest player."

The scandal has revived memories of a government-appointed tribunal in the 1990s finding abuses of European Union beef subsidies at plants Goodman controlled.

The tribunal found that counterfeit stamps had been used in some cases to pass off beef carcases as being of higher quality at some plants controlled Goodman, although it said Goodman himself may not have been aware of the abuse.

Goodman, who declined a request for an interview, has dismissed the tribunal's report as biased.

A well-known figure in Irish business, he has tried to keep a low profile since his ties to prime minister Charles Haughey in the 1980s came close to bringing down the government.

He used ABP to rebuild his empire, which collapsed after a number of disastrous investments in the 1980s and the 1990 Iraqi invasion of Kuwait which left Saddam Hussein's government unable to pay a 170 million pound ($268 million) bill.

The Tesco contract - worth 15 million euros, according to Tesco Ireland - was a small part of ABP's business.

Tesco said it would continue to buy Irish beef worth more than 100 million euros per year from other ABP companies.

Archaic Native Americans built massive Louisiana mound in less than 90 days

Jan. 30, 2013 ? Nominated early this year for recognition on the UNESCO World Heritage List, which includes such famous cultural sites as the Taj Mahal, Machu Picchu and Stonehenge, the earthen works at Poverty Point, La., have been described as one of the world's greatest feats of construction by an archaic civilization of hunters and gatherers.

Now, new research in the current issue of the journal Geoarchaeology, offers compelling evidence that one of the massive earthen mounds at Poverty Point was constructed in less than 90 days, and perhaps as quickly as 30 days -- an incredible accomplishment for what was thought to be a loosely organized society consisting of small, widely scattered bands of foragers.

"What's extraordinary about these findings is that it provides some of the first evidence that early American hunter-gatherers were not as simplistic as we've tended to imagine," says study co-author T.R. Kidder, PhD, professor and chair of anthropology in Arts & Sciences at Washington University in St. Louis.

"Our findings go against what has long been considered the academic consensus on hunter-gather societies -- that they lack the political organization necessary to bring together so many people to complete a labor-intensive project in such a short period."

Co-authored by Anthony Ortmann, PhD, assistant professor of geosciences at Murray State University in Kentucky, the study offers a detailed analysis of how the massive mound was constructed some 3,200 years ago along a Mississippi River bayou in northeastern Louisiana.

Based on more than a decade of excavations, core samplings and sophisticated sedimentary analysis, the study's key assertion is that Mound A at Poverty Point had to have been built in a very short period because an exhaustive examination reveals no signs of rainfall or erosion during its construction.

"We're talking about an area of northern Louisiana that now tends to receive a great deal of rainfall," Kidder says. "Even in a very dry year, it would seem very unlikely that this location could go more than 90 days without experiencing some significant level of rainfall. Yet, the soil in these mounds shows no sign of erosion taking place during the construction period. There is no evidence from the region of an epic drought at this time, either."

Part of a much larger complex of earthen works at Poverty Point, Mound A is believed to be the final and crowning addition to the sprawling 700-acre site, which includes five smaller mounds and a series of six concentric C-shaped embankments that rise in parallel formation surrounding a small flat plaza along the river. At the time of construction, Poverty Point was the largest earthworks in North America.

Built on the western edge of the complex, Mound A covers about 538,000 square feet [roughly 50,000 square meters] at its base and rises 72 feet above the river. Its construction required an estimated 238,500 cubic meters -- about eight million bushel baskets -- of soil to be brought in from various locations near the site. Kidder figures it would take a modern, 10-wheel dump truck about 31,217 loads to move that much dirt today.

"The Poverty Point mounds were built by people who had no access to domesticated draft animals, no wheelbarrows, no sophisticated tools for moving earth," Kidder explains. "It's likely that these mounds were built using a simple 'bucket brigade' system, with thousands of people passing soil along from one to another using some form of crude container, such as a woven basket, a hide sack or a wooden platter."

Kidder analyzes the varied colors and layers of the soils of Mound A, which are a result of the building process. Indians carried basket-loads of dirt weighing roughly 55 pounds and piled them up carefully to form the mound.

To complete such a task within 90 days, the study estimates it would require the full attention of some 3,000 laborers. Assuming that each worker may have been accompanied by at least two other family members, say a wife and a child, the community gathered for the build must have included as many as 9,000 people, the study suggests.

"Given that a band of 25-30 people is considered quite large for most hunter-gatherer communities, it's truly amazing that this ancient society could bring together a group of nearly 10,000 people, find some way to feed them and get this mound built in a matter of months," Kidder says.

Soil testing indicates that the mound is located on top of land that was once low-lying swamp or marsh land -- evidence of ancient tree roots and swamp life still exists in undisturbed soils at the base of the mound. Tests confirm that the site was first cleared for construction by burning and quickly covered with a layer of fine silt soil. A mix of other heavier soils then were brought in and dumped in small adjacent piles, gradually building the mound layer upon layer.

As Kidder notes, previous theories about the construction of most of the world's ancient earthen mounds have suggested that they were laid down slowly over a period of hundreds of years involving small contributions of material from many different people spanning generations of a society. While this may be the case for other earthen structures at Poverty Point, the evidence from Mound A offers a sharp departure from this accretional theory.

Kidder's home base in St. Louis is just across the Mississippi River from one of America's best known ancient earthen structures, the Monk Mound at Cahokia, Ill. He notes that the Monk Mound was built many centuries later than the mounds at Poverty Point by a civilization that was much more reliant on agriculture, a far cry from the hunter-gatherer group that built Poverty Point. Even so, Mound A at Poverty Point is much larger than almost any other mound found in North America; only Monk's Mound at Cahokia is larger.

"We've come to realize that the social fabric of these socieites must have been much stronger and more complex that we might previously have given them credit. These results contradict the popular notion that pre-agricultural people were socially, politically, and economically simple and unable to organize themselves into large groups that could build elaborate architecture or engage in so-called complex social behavior," Kidder says. "The prevailing model of hunter-gatherers living a life 'nasty, brutish and short' is contradicted and our work indicates these people were practicing a sophisticated ritual/religious life that involved building these monumental mounds."

The U.K.'s advertising watchdog has cleared Asda's festive TV campaign featuring an exhausted mother doing all the work to make Christmas a success, despite more than 600 complaints it was offensive and sexist.

See the ad below. It was also accused of discriminating against fathers, who are portrayed as useless guests in their own homes during the holidays.

The TV ad showed a harassed mother swamped with festive preparations: shopping, cooking, cleaning, writing cards, wrapping presents and making beds.

The campaign, which ended with the line "Behind every great Christmas there's mum, and behind every mum there's Asda", prompted 620 complaints to the Advertising Standards Authority.

Asda stuck to its guns, saying that while a large number people might have felt that the ad was sexist, it was simply a fact that women do the lion's share of work at Christmas.

"Extensive consumer research and feedback indicated that the majority of their customers identified with the ad's representation of Christmas," the supermarket said. "Eight out of ten mothers [of 1,896 surveyed] ... believed the ad reflected common experience, rather than outdated stereotypes."

The ASA said that the TV ad was "not likely to be seen as condoning or encouraging harmful discriminatory behavior, or reinforcing negative stereotypes of men or women in general, and, for those reasons, considered it was unlikely to cause serious or widespread offense."

It dismissed the 620 complaints about the ad, which was created by agency Saatchi & Saatchi and also ran on ITV's video-on-demand service, Asda's website and YouTube channel.

Romani artist and Holocaust documenter Stojka dies

VIENNA (Reuters) - Romani artist Ceija Stojka, whose work helped expose the Nazis' persecution of the Romani people, died in a Vienna hospital on Monday aged 79, her publisher told the Austria Press Agency on Tuesday.

Holocaust survivor Stojka wrote one of the first Romani autobiographical accounts of Nazi persecution, the 1988 book "We Live in Seclusion: The Memories of a Romani", and dedicated decades to telling her people's story through music and art.

The Romani people, like the Jews, were sent to concentration camps by Germany's Nazis during the Second World War. Up to 1.5 million were murdered in an attempted genocide.

Austrian-born Stojka survived internment in the Auschwitz, Bergen-Belsen and Ravensbrueck concentration camps, along with just five other members of her 200-strong family.

"I reached for the pen because I had to open myself, to scream," the activist said at an exhibition in Vienna's Jewish Museum in 2004.

The Budapest-based European Roma Cultural Foundation on Tuesday described Stojka as an "outstanding Austrian Romani woman ... and a key figure for the history, art and literature of Romani culture in Europe".

The foundation's executive director, Timea Junghaus, wrote in an email to Reuters: "She was a role model for the present generation and an inspiration for the future generations of Roma in Europe."

Stojka began painting at the age of 56, often using her fingers or toothpicks instead of brushes to apply acrylic paint and ink.

Her works, many of which are recreations of her experiences in the concentrations camps, have been described as "eerie" and "childlike" by viewers of her exhibitions around the world.

Romani people are still subject to forced assimilation or segregation, cultural repression, eviction and other forms of discrimination in many countries, especially in Europe.

The European Union estimates there are between 10 and 12 million Romani people in Europe, making them the continent's largest ethnic minority, although populations are hard to count, since many choose not to register their ethnic identity.

Mass extinction? Man may still have time to catalog Earth's species.

A trio of respected biologists and zoologists concludes that Earth's sixth mass extinction may be unfolding slower than feared, giving time for the valuable work of cataloging the planet's species.

For years, ecologists and biologists have warned that the planet is sliding into a mass extinction event comparable to the one that did in the dinosaurs 65 million years ago.

But Earth?s species may not be vanishing as fast as previously believed ? providing a fresh opportunity to catalog and conserve more of them before global warming and habitat loss take a higher toll on the planet?s biodiversity.

That's the conclusion a trio of respected biologists and zoologists has reached after reviewing recent studies on extinction, the pace at which new species are being reported, estimates of undiscovered species, and the human and technological capital available for building the catalog.

When it comes to discovering and preserving biodiversity, "things aren't hopeless," says Mark Costello, a University of Auckland marine zoologist and the lead author of the analysis, which appeared in this week?s issue of Science.

Three years ago, another, larger team of biologists and zoologists estimated that if collectively countries devoted $500 million to $1 billion a year to the project of cataloging nonbacterial life on Earth, the project could be complete within 50 years.

Dr. Costello and colleagues renew that call. And their lower estimate of the number of species and a higher estimate of the people available than many thought implies the job could be done more quickly.

The stakes are high, many researchers say. Human population growth and activities ? from altering landscapes and oceans to altering climate ? are widely seen as the drivers behind the current mass-extinction event, the planet?s sixth.

"We are the asteroid," says Michael Novacek, provost and curator at the American Museum of Natural History in New York, referring to the event widely held to have triggered the demise of the dinosaurs 65 million years ago.

"This may be the most important century in our evolutionary history, where the environment is really transformed to a level where the nature of life on Earth is redefined," says Dr. Novacek, who was not part of the team performing the new analysis.

Getting a handle on the full range of nonbacterial species the planet hosts is important for a number of reasons, researchers say. A full listing of what lives where would provide important information for maintaining the health of ecosystems on which humans rely for food, clean water, and other so-called ecosystem services. And undiscovered species could represent new sources of compounds for pharmaceuticals or appear as novel structures human engineers could mimic for lighter, stronger materials.

At its broadest, the widespread loss of biodiversity before anyone has a chance to take the full measure of what's out there makes it difficult to fully grasp the ecological consequences of its loss.

Novacek and others say they are a bit surprised at the relatively low number of nonbacterial species the team estimates as living on the planet ? about half the 10 million that others estimate as realistic. And the trio's estimate for a global extinction rate ? less than 1 percent per decade ? is far below the worst-case scenario of 5 percent per decade some have estimated.

Still, Costello and colleagues acknowledge that if extinction rates are on the high side, say 5 percent per decade, half the 5 million nonbacterial species he and his colleagues estimate as currently inhabiting Earth will have vanished within 150 years.

U.N.'s Ban says aid response for Syria "very limited"

KUWAIT (Reuters) - The United Nations is receiving only limited support for its aid to millions of Syrians, Secretary General Ban Ki-moon said in published remarks, adding its humanitarian work needed "generous" help from a donor pledging conference on Wednesday.

The gathering in the Gulf Arab state of Kuwait will seek $1 billion of aid for Syria's neighbors sheltering 700,000 registered refugees, and another $500 million to bankroll humanitarian work for 4 million Syrians inside their country.

So far, the United Nations has received pledges covering just 18 percent of the target, unveiled last month as the scale of Syria's humanitarian crisis escalated sharply, and which aims to fund operations for the first half of this year.

Ban was quoted by the official Kuwait News Agency (KUNA) as saying what while the need for humanitarian aid was rising "the level of response the U.N. is receiving is very much limited."

"That is why I am appealing to the whole international community to render their generous support."

Some 4 million Syrians inside the country need food, shelter and other aid and more than 700,000 more have escaped to neighboring countries since the 22-month-old conflict began, according to the U.N.

KUNA reported Ban as saying that on a visit to refugee camps in Jordan and Turkey six weeks ago he heard stories of refugees who had fled Syria "and particularly stories from children, who were very much concerned about their own future."

"That really saddened and humbled me."

Robert Watkins, U.N. humanitarian coordinator in Lebanon, which has seen the biggest influx of refugees from the Syrian bloodshed, told Reuters that the United Nations had received promises of major donations at the Kuwait conference.

"We have every reason to be optimistic that there will a very good presence and new pledges that will be coming up at this conference," he said.

U.S. President Barack Obama announced an additional $155 million, bringing the total U.S. humanitarian aid to the Syrian crisis to some $365 million, the State Department said.

Watkins said the fact that the conference was being held in Kuwait could encourage other wealthy Gulf Arab states, who have led regional opposition to President Bashar al-Assad, to support the international aid effort.

In New York, U.N.-Arab League mediator Lakhdar Brahimi warned the U.N. Security Council on Tuesday that Syrian President Bashar al-Assad may be able to cling to power for now but the country is "breaking up before everyone's eyes," diplomats told Reuters.

Brahimi suggested that attempts to end the 22-month-old conflict, which has claimed more than 60,000 lives according to U.N. figures, had not progressed in the last two months. He said it was up to the Security Council to end its impasse.

If you have a daughter then you will be planning a Sweet 16 Birthday party at some point. It is one of the biggest moments in a girls life. There are many parents who go all out for this particular birthday having a prom like party. Depending on your culture this may be the way you go. These are of course just a few of the million of themes that you can plan. As I said before many go the prom like route with everyone dressing up and the event being formal. The girl turning 16 usually wears a white dress (although this tradition has changed during recent years) and she wears a tiara or crown as well. The ideas is that she is queen of the ball.

Research teams from Russia, the United Kingdom and United States have each spearheaded drilling efforts over the past few years to pierce and sample separate subglacial Antarctic lakes. Russian scientists reported last year piercing into Lake Vostok but has so far turned up no identifiable life. Those researchers are now working to analyze a new sample of ice recently retrieved from that drill project. Last month, the British team suspended its efforts for this summer season (which ends next month) to reach Lake Ellsworth.

The just-completed borehole into Lake Whillans ?marks the first successful retrieval of clean whole samples from an Antarctic subglacial lake,? the U.S. team reported today. ?Water and sediment samples returned to the surface are now being processed to answer seminal questions related to the structure and function of subglacial microbial life, climate history, and contemporary ice sheet dynamics.?

A research team led by Frank Rack, of the University of Nebraska, Lincoln, recently developed and field-tested the novel hot-water drill used to cut through the roughly half-mile-deep sheet of ice to reach Lake Whillans. ?Over the whole Antarctic continent, there are more than 340 [subglacial] lakes,? he notes. ?We selected this one because we know that it goes up and down, which means that the water underneath the ice sheet is periodically filling up the lake, then draining out again.?

Researchers have monitored this cycle through a rise and fall of the surface of that portion of the ice sheet covering the lake. Each cycle can last up to a decade, Rack says.

A video camera and series of sampling instruments will be periodically lowered down the borehole in the day or two available before this portal begins freezing shut again. ?Lake Whillans has already presented surprises,? according to Doug Fox, a reporter embedded with the drill research team, which is camped out less than 400 miles from the South Pole. ?For one, the lake has turned out to be only five or six feet deep ? shallower than the 20 to 30 feet that people expected based on seismic measurements,? Fox reported in a blog on the Discover website.

When I met with the Lake Whillans research team, last month, they planned to begin analyses of retrieved water and sediment within minutes of it reaching the surface. A series of mobile research labs were recently hauled to the Lake Whillans drill site. At least one lab will be used to study the chemistry of the water. Another will focus on probing for signs of microbial life ? chiefly bacteria and viruses.

Jurassic Park 3D Bluray comes home April 23rd after its oneweek theatrical return

We've known since last year that Jurassic Park would make its return to theaters in 3D this April, but now Universal has also dropped the details about its Blu-ray 3D release, as well as the 2D release of all the flicks individually in March. Just to fill in the timeline: first Jurassic Park 1, 2 and 3 will hit Blu-ray/DVD individually (following the triple pack that shipped in 2011) on March 26th, then Jurassic Park in 3D arrives April 5th in regular and IMAX theaters (no, the now-dated CGI has not been redone, you can get a peek in the trailer embedded after the break) followed finally by the Blu-ray 3D April 26th.

While news that the flick is back on the big screen is exciting, we can't help but think there's a few missed opportunities here like the previously mentioned CGI, and lack of any extras detailing the conversion process on the disc. Still, some had complaints about the picture quality of the previous release and it's possible that remastering done in the name of 3D could see a better version this time around for all viewers. Either way, after Titanic, I, Robot and even Top Gun seeing 3D re-release it appears this is definitely a trend. The individual movies are priced at $24.49 on Amazon, and the 3D combo pack is $34.99.

Qigong Improves Quality of Life for Breast Cancer Patients  New research has found that qigong, an ancient mind-body practice, has been found to reduce depression and improve the quality of life in women undergoing radiation for breast cancer.

The study examined qigong in patients receiving radiation therapy and included a follow-up period to assess its benefits over time, according to researchers.

?We were [...] particularly interested to see if qigong would benefit patients experiencing depressive symptoms at the start of treatment,? said Lorenzo Cohen, Ph.D., a professor in the University of Texas M. D. Anderson Cancer Center?s Departments of General Oncology and Behavioral Science.

?It is important for cancer patients to manage stress because it can have a profoundly negative effect on biological systems and inflammatory profiles.?

For the study, Cohen and his colleagues recruited 96 women with stage 1-3 breast cancer from Fudan University Shanghai Cancer Center in Shanghai, China.

About half of the women ? 49 ? were randomly assigned to a qigong group consisting of five 40-minute classes each week during their five-to-six week course of radiation therapy. The remaining 47 women comprised a control group receiving standard care.

The program incorporated a modified version of Chinese medical qigong, which consisted of synchronizing one?s breath with various exercises, the researchers explained.

Participants in both groups completed assessments at the beginning, middle and end of radiation therapy and then one and three months later. Different aspects of quality of life were measured, including depressive symptoms, fatigue, sleep disturbances, and overall quality of life.

According to the researchers, patients in the qigong group reported a steady decline in depressive symptom scores beginning at the end of radiation therapy, with a mean score of 12.3, through the three month post-radiation follow-up with a score of 9.5. No changes were noted in the control group over time, the study found.

The study also found that qigong was especially helpful for women reporting high baseline depressive symptoms, Cohen said.

?We examined women?s depressive symptoms at the start of the study to see if women with higher levels would benefit more,? he said.

?In fact, women with low levels of depressive symptoms at the start of radiotherapy had good quality of life throughout treatment and three months later regardless of whether they were in the qigong or control group. However, women with high depressive symptoms in the control group reported the worst levels of depressive symptoms, fatigue, and overall quality of life that were significantly improved for the women in the qigong group.?

As the benefits of qigong were largely observed after treatment concluded, researchers suggest qigong may prevent a delayed symptom burden or expedite the recovery process, especially for women with elevated depressive symptoms at the start of radiation therapy. Cohen notes the delayed effect could be explained by the cumulative nature of the treatments, as the benefits often take time to be realized.

According to the researchers, the findings support other previously reported trials examining the benefits of qigong, but are too preliminary to offer clinical recommendations.

They note that additional research is needed to understand the possible biological mechanisms involved and further explore the use of qigong in ethnically diverse populations with different forms of cancer.

The study was published in the journal Cancer.

Why You Should Never Skip Flossing Your TeethIn my mid-twenties I decided, after about 5 years of putting it off, that it was time for a dental check up. And even though it had been so long since I had been sitting in that uncomfortable room, I was told that my teeth were near perfect. The thing about these moments?where you think you're "special"?is that they can go to your head.

For example, on my first visit to a horse race I won $270. I thought I was ?special' in the way that I knew how to pick winning horses. I wasn't; every cent of that $270 was lost when I went back the following week.

But I digress. This is about teeth?no wait, it's about more than that; this is about habit and remembering. After all, a habit is simply remembering to do something based on a thought or experience.

Just recently I decided that I would give myself another dental check up. I seemed to have forgotten my horse racing lesson because I was expecting to have perfect teeth, again. I didn't. I was given a bill that would be the equivalent of buying a decent used car. Ugh. Could I have prevented this? Yes, I could have. If only I had been flossing my teeth two times a day, I would have had less problems.

I'll admit, my teeth are in very good condition when I compare them to other peoples' teeth. But that doesn't mean that they will always be that way, right? Just because you are in a position where you are "ahead," it doesn't mean that it will always be that way. Similar to how numero uno has only one way to travel?downwards, number two has options?forward or back. Perhaps that is why some people never try to be the best; people might subconsciously like the option of being number one, but don't want to be in the position to have to defend it. Or maybe, being number one or the best makes you lazy.

Not flossing my teeth twice a day was, I admit, due to laziness. I thought I was okay, everything would be okay, and nothing wrong would ever happen. There is a lesson in all of this; and it will vary from individual to individual, but the overarching take away is this: floss your teeth. Defend your status. As you acquire more, or you are born with more, you are that way because others before you helped. It takes responsibility, and work, to maintain or grow. Some people might think that the way to keeping your teeth looking good is to knock out everyone elses' teeth, or take away their dental insurance so their teeth go bad.

That is not the way to go. Floss your teeth two times a day. Your dentist and your gums will thank you.

Waiting for LTE to roll out to your neighborhood? FCC Chairman Julius Genachowski understands, and he's trying to speed up the process. The commission's head honcho recently announced new actions to the Broadband Acceleration Initiative, clarifying technical provisions within the Middle Class Tax Relief and Job Creation Act of 2012 that should make mobile broadband deployment a little easier. The crux of the change focuses on how requests to modify existing base stations and wireless towers are reviewed, and is designed to give providers less pause when investing in building out their infrastructure.

"Just as is the case for our nation's roads and bridges, we must continue to invest in improvements to cell towers and transmission equipment, in order to ensure ubiquitous, high-speed Internet for all Americans," Genachowski said in an official statement. "To keep pace with technological advances, such as the advent of small cells, and to lay the groundwork for new developments, our policies must continue to adapt." Speaking of adaptation, the Chairman's announcement also noted FCC efforts to expedite the installation of temporary cell towers, used to bolster network capacity for events like the Super Bowl or Olympics. FCC CHAIRMAN JULIUS GENACHOWSKI ANNOUNCES NEW BROADBAND ACCELERATION INITIATIVE ACTIONS; CLARIFIES RULES TO SPEED WIRELESS INFRASTRUCTURE DEPLOYMENT; MOVES TO EXPEDITE TEMPORARY CELL TOWERS

Actions would provide more certainty to providers and spur private investment and deployment of critical high-speed Internet equipment

(Washington, D.C.) - FCC Chairman Julius Genachowski today announced new actions as part of the Broadband Acceleration Initiative, a comprehensive effort to remove barriers to broadband build-out, including streamlining the deployment of mobile broadband infrastructure, such as towers, distributed antenna systems (DAS) and small cells.

The Commission defined and clarified a technical provision in the Middle Class Tax Relief and Job Creation Act of 2012 regarding local review of requests to modify an existing wireless tower or base station. This provision will accelerate deployment and delivery of high-speed mobile broadband to communities across the nation. This action will create greater certainty and predictability for providers that today invest more than $25 billion per year in mobile infrastructure, one of the largest U.S. sectors for private investment.

The Commission today also launched a proceeding to expedite placement of temporary cell towers - cells on wheels (COWs) and cells on light trucks (COLTs) - that are used to expand capacity during special events, such as the Inauguration or the Super Bowl.

Chairman Genachowski also announced actions in the coming months to further streamline DAS and small cell deployment; examine whether current application of the tower siting shot clock offers sufficient clarity to industry and municipalities; and begin developing model facility siting rules for localities. Each of these actions would contribute to faster, more efficient deployment of wireless infrastructure.

Chairman Genachowski said, "Providing more certainty to industry and municipalities, and more flexibility to carriers to meet extraordinary, short-term service needs will accelerate private and public investment to strengthen our nation's communications networks. Just as is the case for our nation's roads and bridges, we must continue to invest in improvements to cell towers and transmission equipment, in order to ensure ubiquitous, high-speed Internet for all Americans. To keep pace with technological advances, such as the advent of small cells, and to lay the groundwork for new developments, our policies must continue to adapt."

This explains why her most important accomplishments to date are having been reprimanded for climbing trees on three continents and nearly freeing a monkey within one week of assuming her first full-time teaching post. Her poems have appeared in or are forthcoming in Arsenic Lobster, Redactions: Poetry and Poetics, Strange Horizons, Whiskey Island, and WomenArts Quarterly. ?We Are Supposed To Be Truth Tellers?

Image (1) cnetcbs.png for post 17592A couple of weeks ago CNET was put into an absurd situation – they could not favorably cover a technology product because the company behind that product was in litigation with CNET’s parent company, CBS. I wasn’t all that interested in the story at the time. Reporters and bloggers are constantly pressured to write or not write about things by parent companies and even business executives in their own companies. CBS telling CNET what it could and could not write about wasn’t anything I haven’t seen before. I understand why CBS was trying to control messaging about a company that they were suing, although they certainly weren’t very smart about how they handled it. The Streisand Effect kicked in and not only did the product end up getting tons of extra positive press, but both CBS and CNET looked like idiots. Still, big companies do stupid things all the time. It’s a big part of why small startups are often so successful at disrupting them. What I don’t get is why CNET staffers have stuck around. They’re the ones who are supposed to be journalists and all that entails. They’re the ones I blame right now. I blame them because they’re the only reason CBS is able to get away with this. Every single journalist at CNET should have resigned by now. More than once at TechCrunch we made AOL extremely uncomfortable with things that we wrote. But they never ordered us to write or not write about something because they understood that not only would we not comply, we’d write a post about how the whole thing. Our independence from AOL was so important to me that I negotiated an extremely odd provision in our purchase agreement that allowed me to disclose confidential information about AOL. It was their job never to give me that information. It was not my job to protect it in any way. If AOL had ever ordered me to remove a piece of content from the site for any reason I would have immediately written about it and disclosed the situation to our readers. And if I had ever ordered a writer to remove content I would have expected that writer to have done the same to me. The biggest trend in laptops right now is the move from traditional laptops to touch-centric tablets and convertible designs. For those who want to get the touch capability needed to make the most of Windows 8, but don't want to leave behind the standard laptop design, there are touch-enabled laptops, like the Asus VivoBook X202E-DH31T. While there are plenty of new touch laptops on the market now, not all of them are affordable, but the X202E-DH31T's price tag puts it in a reasonable price range. You may lose some of the performance and battery life offered by more expensive options, but the affordability makes up some of the difference.

Design
The X202E-DH31T is a slim ultraportable, measuring 0.8 by 11.9 by 7.9 inches (HWD) and weighing a very portable 2.9 pounds, making it about the right thickness and weight for an ultrabook, though it's missing the requisite solid-state drive or flash memory cache that's one of the requisites of the ultrabook category. While it may not bear Intel's ultrabook moniker, the X202E-DH31T is equipped with something equally compelling?a touch screen, complete with 10-finger tracking and touchable bezels to allow Windows 8 gestures such as swiping in from the sides of the screen.

Unlike convertible designs, such as the sliding Sony VAIO Duo 11 (D11213CX) or the Lenovo IdeaPad Yoga 13, the X202E-DH31T can't change out of its clamshell form factor. One point of irritation, however, is the screen's hinges, which wobble quite a bit when the screen is touched. On a device that features a touch screen, the hinges need to be sturdy enough to withstand all of the poking and prodding that comes with it.

The 11.6-inch display offers a resolution of 1,366-by-768, which?while not as exciting as the 1080p display of the Dell XPS 12?is par for the course in this price range. But while the resolution is on the acceptable side of the line dividing passable from the mediocre, the overall quality of the display is not. The viewing angles are lousy, the display is dim, even with the brightness turned up, and the display is prone to reflecting every glint and glare. It's fine for browsing the Web or typing a document, but it's still a letdown.

Slightly better are the Asus SonicMaster speakers tucked out of sight along the hinge. They offer decent sound at quiet volumes and while the sound gets tinny at high volume, it's still pretty clear, with some buzzing treble, but moderately clear bass.

The chiclet-style keyboard is approximately full-size, but the keys themselves are a little small, making for a cramped typing experience. It's not as bad as that of the Sony VAIO Duo 11, but the keys do have the same short (1.6mm) key travel. The laptop's clickable touchpad combines the right and left buttons into the 4.1-by-2.4-inch surface of the touchpad for a larger area of touch tracking. It supports both standard gestures, like two=finger scrolling and pinch zoom, and Windows-8-specific gestures, such as swiping from the edges to activate Charms and cycle through apps.

Features
The X202E-DH31T has a fairly standard selection of features, with two USB 2.0 ports and one USB 3.0 port for connecting high-speed portable drives and high capacity flash drives; VGA and HDMI outputs for connecting to monitors, projectors, or HDTV; and a compact Ethernet port for those instances when the built-in 802.11n Wi-Fi won't do the trick. A 2-in-1 card reader supports both SD cards and Sony's Memory Stick formats, while a Kensington lock slot lets you physically secure the laptop while in a public place. In addition to a stereo minijack for headphones, the X202E-DH31T also has Bluetooth 4.0, and a 0.3MP webcam is available for Skyping and other video chat applications.

The X202E-DH31T is outfitted with a 500GB hard drive, which is a fairly decent amount of storage space (the VAIO Duo 11 only had a 128GB SSD), but it lacks the additional flash memory for faster wake times and performance, which will prevent it from having the same snappy responsiveness offered by similar looking ultrabooks.

The laptop features Windows 8 Home Premium (64-bit), with programs preinstalled on both the Start Screen and the traditional desktop, including a 60-day trial of McAfee Internet Security 2012, LoJack for Laptops, an upgradeable version of Microsoft Office 2010 Starter, and Adobe Reader. Asus also has some branded apps and programs, such as Asus WebStorage and Asus Game Park Console, which provide some free online storage and basic games, respectively. Asus also covers the X202E-DH31T with both a standard one-year warranty on parts and labor, additional accident protection (covering spills, power surges, and fire damage), and a 30-day "Zero Bright Dot" warranty on the display.

Performance
Asus VivoBook X202E-DH31T The X202E-DH31T is equipped with a 1.8GHz Intel Core i3-3217U low-voltage processor, the same CPU found in the budget Editors' Choice Acer Aspire V5-571-6891. Compared to the Intel Core i5 and Core i7 processors found in the Lenovo Yoga 13, the Sony Duo 11 and the Dell XPS 12, the VivoBook's Core i3 is rather puny, and it's slowed down further by the spinning hard drive?the competitors listed all rely on solid-state drives (SSDs) for faster performance.

As a result, the X202E-DH31T's performance lagged considerably, crawling through tasks like our Photoshop test in 8 minutes 46 seconds. By comparison the Lenovo Yoga 13 (6:35) and Dell XPS 12 (6:31) both finished the same test more than two minutes faster. Handbrake scores were similarly lopsided, with the VivoBook (2 minutes 15 seconds) dragging behind the Lenovo Yoga 13 (1:34) and the Sony VAIO Duo 11 (1:25).

Additionally, while the X202E-DH31T also has Intel's integrated HD Graphics 4000 processing, it couldn't run our Aliens vs. Predator test, and only ran Heaven at 1366-by-768 resolution and medium detail for an unplayable 4 frames per second.

The real nail in the coffin, however, was battery life. Despite the sub-3-pound weight and ultra-low-voltage processor, the X202E-DH31T (and its 38Wh, 2-cell battery) only lasted 3 hours 50 minutes in our video rundown test. By comparison, the Lenovo Yoga 13 lasted five hours, while the Dell XPS 12 a little longer (5:09). The Sony Duo 11 lasted closer to that of the X202E-DH31T at 3:09.

The new range of hybrid tablets and touchable laptops on the market now may offer better performance and battery life, but the Asus VivoBook X202E-DH31T puts touch capability into an affordable price range, which may make it worthwhile despite the flaws. Compared to other 10- to 12-inch touch-capable Windows 8 laptops, it's cheap and usable, if not as portable and powerful as leading systems, like the Lenovo IdeaPad Yoga 13. But the price is hard to beat, especially when compared with the budget laptop Editors' Choice Acer Aspire V5-571-6891, which is only $50 less, without touch.

Aretha Franklin Approves of Beyonce's 'Beautiful' Inaugural Lip-Syncing

LOS ANGELES (TheWrap.com) - Aretha Franklin r-e-s-p-e-c-t's Beyonc?'s decision to use a "beautiful" pre-recorded rendition of the national anthem during President Barack Obama's inaugural ceremony on Monday.

The Queen of Soul, who sang "My Country 'Tis of Thee" during Obama's inauguration in 2009, told ABC News that the cold weather warranted Beyonc? lip-syncing "The Star-Spangled Banner."

"The weather down there was about 46 or 44 degrees and for most singers that is just not good singing weather," Franklin said after noting the news gave her a good laugh. "When I heard that I just really cracked up. I thought it was really funny, but she did a beautiful job with the pre-record ... next time I'll probably do the same."

She says "next time," because she wasn't afraid to brave below-freezing temperatures in Washington D.C. when she performed live four years ago. "In 2009, I wanted everything to be live and on the real side for the moment as it actually happened. Those were my feelings for my performance, but having come face to face with 28, 22 degrees I am not surprised she pre-recorded," Franklin continued. "She wanted her performance to be what she wanted to be and she realized it wasn't going to be the way she wanted it to be or she was going to be running a risk. That's probably why she pre-recorded exactly how she wanted it to be heard."

The 70-year-old Franklin isn't the only music star shrugging off Beyonc?gate. Jennifer Lopeztold Jon Stewart on Tuesday's episode of "The Daily Show" that "all performers do have to" lip-sync at some point in their career.

"You know, sometimes it happens," she explained. "When you're in certain stadiums and in certain venues, they do pre-record things."

Lopez's former "American Idol" judging panel partner, Steven Tyler, isn't particularly bothered by Beyonc? lip-syncing either. "It doesn't matter," he told TMZ.

"Beyonc?'s so hot, she can do anything," the Aerosmith frontman added to give some shallow perspective. "Let's just get real."

Whether or not Beyonc? would agree with Tyler's flattering statement, she has yet to comment on the matter herself, aside from posting the performance on her Tumblr -- an action that suggests she has no regrets.

Meanwhile, the U.S. Marine Band that previously admitted to using a pre-recorded track to back her performance and suggested Beyonc? did the same for her vocals, has changed its tune.

"Each piece of music scheduled for performance in the Inauguration is pre-recorded for use in case of freezing temperatures, equipment failure, or extenuating circumstances," a spokesman for the Marines told TheWrap on Tuesday. "Regarding Ms. Knowles-Carter's vocal performance, no one in the Marine Band is in a position to assess whether it was live or pre-recorded."
